Three corporations and directors in Ottawa faces $720,000 fine

Three corporations and its directors were fined a total of $720,000 for failing to pay wages and comply with the demand to produce records.

According to the Ministry of Labour, Immigration, Training and Skills Development, the three convicted corporations, 11997629 Canada Ltd., 8633177 Canada Inc. and 9039376 Canada Inc., which have operated under several names such as Trinity International Investments. Its corporate directors who were also convicted were Keo Vichira Yong, Doris Sow and Korka Sow.

It was found that they had committed 20 offenses under the Employment Standards Act (ESA) as well as 18 counts of failure to comply with orders to pay wages and two counts of failure to comply with demands for records.

About seven employees from the three corporations had filed claims to the ministry regarding unpaid wages. It was found that they were owed around $340,000. The employment standards officer who investigated the case had issued orders for the owed wages to be paid but the companies and the directors did not comply.

The officer was also not able to determine if there were more employees who were owed wages as the companies were not also able to produce the records that were demanded.

Due to the offence, the three directors were fined with a total of $175,000 while the corporations needed to pay $545,000 by Justice of the Peace Mahamud Hussein Elmi, with the crown counsel being Madeleine Chin-Yee.
